Worrigee Subdivision Update (File DA09/1735)

The appeal in the Land & Environment Court in relation to DA09/1735 has been set down for hearing on 13, 14 & 15 October 2010. The hearing will take place in Nowra Local Court. The applicant will be proceeding on the amended plans as recently exhibited on the DA tracking site. Residents who have lodged a submission about the proposal will be contacted shortly about participation in the hearing.

The appeal in relation to DA09/1735 for proposed integrated housing at Worrigee Road, Worrigee was listed before the Court for a section 34 mediation conference today. The parties were unable to reach agreement at the mediation conference. As such, the appeal will now proceed to a formal hearing. Residents will be advised of the hearing date once this is set by the Court.

Following the mediation conference held with the Land & Environment in relation to DA09/1735 on 26 May 2010, amended plans have been received by Council seeking the approval for an amended subdivision & integrated housing proposal. The amended plans can be viewed via DA Tracking or at Council’s office. Submissions will be accepted until 5pm on 12 July 2010.

The appeal to the Land & Environment Court has been listed for
a section 34 conference on 26 May 2010.
A section 34 conference is similar to a conciliation conference, where a
Commissioner of the Court will discuss issues raised by both
parties. The Court can allow the parties to reach agreement at the
conference. If the conference is unsuccessful in reaching agreement,
the matter will proceed to a hearing proper at another date.
Council’s solicitors have recently written to residents who have made a
submission in relation to the development application about the appeal.
Residents are invited to attend a briefing with Council’s solicitors
about the appeal on 19 May 2010 at 5.30pm at Council’s Administrative
Building, Nowra.

The applicant has lodged an appeal in the Land and Environment Court against
Council’s deemed refusal of the application. The appeal relates to the latest
amended plans submitted by the applicant. There is no hearing date for the
appeal yet.

The independent consultant engaged by Council to assess this
application identified various deficiencies. The applicant has now
lodged further revised plans and some reports, however other reports
remain outstanding. Planning laws do not restrict the number of revised
plans that can be submitted during the assessment process. The revised
details will be re-notified once the outstanding reports are submitted.
Submissions previously lodged will still be considered for the revised
application. A report to Council will be prepared at the conclusion of
the notification/referral period, once all information has been received
and reviewed.

Amended plans and reports have been submitted by applicant. These
supersede earlier versions of the documents which become redundant. Only
the latest versions are considered in the assessment. This is not
unusual and is permitted by the relevant legislation. In response to the
concerns related to Council’s prior ownership of the subject land,
independent consultants have been contacted to assess the application
rather than Council staff. Submissions previously lodged will still be
considered for the amended application. Following the completion of the
assessment, the application will be reported to the elected Council for
